Terms of Service

These terms form an agreement between you and the operator of krutaek.com. By registering or using this site you confirm you have read and accepted them. If you do not accept them, please stop using the service.

The Thai version of these terms prevails if there is any discrepancy between language versions.

1. What This Service Is — Please Read This First

krutaek.com is a classifieds marketplace where users buy and sell Thai amulets and sacred objects directly with one another (C2C). We provide the space, the search tools and reference data.

What we are not, and do not do

We are not a party to any sale. The contract of sale is formed directly between buyer and seller.
We do not hold your money, do not act as a payment intermediary, and provide no escrow service. All payment happens outside our platform, directly between you and your counterparty.
We do not authenticate amulets and make no representation as to authenticity, age, provenance or value of anything listed.
We are not responsible for the outcome of any transaction — non-delivery, items not as described, payment problems, or any dispute between counterparties.

Due diligence is your responsibility. Check the seller, inspect the item or request further photographs where appropriate, ask about provenance, and assess the risk before transferring money. Where certification or expert examination services appear on the site, the resulting opinion belongs to the issuing certifier, not to us.

2. Eligibility and Accounts

2.1 Eligibility

You must be 20 years of age or older, or have the consent of a parent or legal guardian
You must have legal capacity to enter into contracts
You must not be a person whose account was suspended or blocklisted here who is registering again to circumvent that

2.2 Account holder duties

Provide truthful information and keep it current
Keep your password confidential. Everything done through your account is treated as done by you, unless you can show it resulted from unauthorised access not caused by your own negligence
One person, one account. Do not create multiple accounts to evade controls, inflate ratings, or bypass a suspension
Do not buy, sell, rent or transfer your account
Notify us immediately if you suspect someone else is using your account

2.3 Identity verification

Some features — selling, opening a shop, or participating in high-value listings — may require identity verification. We may request further documents where there is reasonable cause for concern, and may suspend the relevant feature until verification is complete. Verification data is handled per the Privacy Policy.

3. Suspension and Blocklisting

3.1 Grounds for suspension or closure

Breaching these terms or the listing rules in section 4
Deceptive or fraudulent conduct, or reasonable grounds to believe it is about to occur
Shill bidding, rating manipulation, or coordinated use of multiple accounts to distort the market
Repeated default — for example winning auctions without paying, or reserving without confirming
Harassment, threats or abusive language toward other users or staff
An order from a competent authority or court

3.2 The blocklist

We maintain a blocklist to prevent repeat harm to other users, on these principles:

Evidence to the required standard is needed before listing anyone — bare allegations are not enough
Every entry has an expiry date. There is no automatic lifetime listing
You have the right to appeal with counter-evidence, reviewed by someone other than whoever made the original decision
False reports have consequences. Anyone who knowingly submits false information to harm another user becomes subject to section 3.1 themselves

3.3 Effect of suspension

On suspension, open listings are hidden and you cannot join new auctions or preorders. Obligations incurred beforehand — outstanding payments, or delivering goods already paid for — remain binding on you.

3.4 Closing your own account

You may close your account at any time from My Account. Data handling after closure follows section 10 of the Privacy Policy. Pending transactions must be completed first.

4. Listing Rules and Content

4.1 Prohibited listings

Illegal goods, stolen goods, unlawfully obtained items, or items with disputed ownership
Antiquities or art objects whose trade or export is restricted by law, including objects removed from temples or historic sites
Parts of protected or prohibited wildlife — ivory, tiger fangs, rhinoceros horn — and amulets incorporating them
Objects incorporating human remains
Weapons, narcotics, and anything else the law prohibits trading
Goods infringing another party's copyright or trademark
Listings falsely implying this site endorses or is selling the item

4.2 Accuracy about the item

State the facts — model, year, temple, material, size, condition and flaws
Do not claim authenticity you cannot verify. State "authenticity not warranted" or "sold as-is" where that is the truth
Do not cite certificates that do not exist, are forged, or belong to a different object
Do not use other people's photographs or photographs of a different object. Duplicate-image detection is in place
Do not make exaggerated claims. Do not state that an amulet cures illness, brings wealth, or produces any particular outcome. Belief in an object's power is a personal matter
Do not post duplicate listings for the same object to boost visibility

4.3 Our rights over listings

We may edit, hide or remove a listing where there is reasonable cause to believe it breaches section 4, or where a substantiated report is received. We will tell the poster why and allow them to respond, except in urgent cases where harm must be stopped first.

We have no obligation to pre-screen every listing, and the continued presence of a listing does not mean we have reviewed or endorsed it.

5. User Content and Image Rights

5.1 You keep ownership

Images, text, articles, reviews and other content you upload remain yours. We do not take ownership.

5.2 The licence you grant us

By uploading content you grant us a non-exclusive, royalty-free, worldwide licence to store, reproduce, resize, watermark, translate and publish it as far as necessary to operate and promote the service — listing pages, search results, aggregate pages, search engine previews, and our own promotional material.

The licence ends when you delete the content, except for routine backup copies and content other users have already shared or quoted.

5.3 Your warranties

You own the content or have the owner's permission
It infringes nobody's rights and breaks no law
Where other people appear in an image, you have their consent

5.4 Reporting infringement

If you believe content on this site infringes your rights, write to [ติดต่อ: อีเมลบริษัท] with the link, evidence of ownership and your contact details. We will investigate and act as appropriate, giving the accused party an opportunity to respond.

6. Auctions

6.1 Bids are binding

A bid is a binding offer and cannot be retracted, except where the rules of that particular listing allow it.

6.2 Proxy bidding

If you set a maximum, the system bids on your behalf in increments only as far as needed to keep you the highest bidder, never above your maximum. Your maximum is confidential and cannot be seen by the seller or by other bidders.

6.3 Closing and time extension

Listings close at the stated time. A bid placed near the end may extend the closing time under that listing's rules, so that last-second bidding does not confer an unfair advantage. Extension rules are shown on the listing page before you bid.

6.4 If you win

The winner must contact the seller and complete the transaction within the timeframe stated in the listing. Payment and delivery occur directly between you and the seller; we take no part in receiving funds.

6.5 Default

If the winner fails to act within the timeframe, the seller may report it. Consequences may include a recorded default, a reduced trust score, restricted access to future auctions, and account suspension for repeat occurrences. The system may allow the seller to offer the item to the next-highest bidder (second chance), which that bidder is free to accept or decline.

6.6 Seller obligations in auctions

Sellers must actually possess the item, describe its condition truthfully, not cancel without good cause once bidding has started, and must not bid on their own listings themselves or through associates to inflate the price. Detection for this behaviour is in place.

6.7 Fees

Participation and closing fees may apply as published on the packages page and the listing page. The rate displayed at the time you participate is the rate that applies.

7. Preorders

7.1 Reserving a slot

Reserving holds a slot temporarily in the order the system received the request. Held slots have a limited lifetime and return automatically to the shared quota if you do not confirm in time.

7.2 Confirmation and deposits

Some preorder rounds require a deposit or payment to confirm. Deposit terms, amounts, deadlines and refund conditions belong to the organiser of that round and are shown on the round page before you reserve. Read them each time. We neither receive nor hold deposits.

7.3 Default and cancellation

Reservers who do not confirm or pay on time forfeit the slot, which is reallocated. Repeat defaults affect eligibility for future rounds
Organisers who cancel a round or cannot deliver must refund reservers on the terms they published. We are not responsible for issuing refunds, but we do record the history and may withdraw that organiser's ability to open new rounds

7.4 Limited quantities

Each round has a limited number of slots as published by the organiser. Order is decided by the time the request is received. Being early is not a guarantee of allocation — where simultaneous requests exceed the quota, the excess is refused.

8. Reference Prices and Price Indices

Reference prices, price charts, popularity rankings and regional statistics on this site are computed from transactions and listings occurring on this platform, which is only part of the wider market.

They are reference information to support your own decision, not a formal valuation
They are not investment advice and are not an inducement to buy or sell anything
They are not an authenticity assessment. Appearing in the index does not mean an item has been examined
The real value of an individual piece depends on condition, aesthetics, provenance and piece-specific factors that aggregate figures cannot capture
Past performance does not indicate future results. The value of amulets fluctuates and can fall

Any decision to buy or sell based on this information is at your own risk and responsibility.

9. Folk Belief Content, Lucky Numbers and Dream Interpretation

The site contains folk belief content such as dream interpretation, lucky numbers, and suggestions about sacred objects.

This content exists for entertainment and for preserving folk knowledge only.

It is not a prediction with any assured outcome, and is not financial, legal or medical advice
We do not encourage the use of these numbers for gambling in any form and accept no responsibility for losses arising from doing so
If you have a health problem, consult a doctor. Do not substitute an amulet for medical treatment

10. Fees and Packages

Rates, benefits and conditions for each package are shown on the packages page
The rate published at the time you subscribe applies to that billing period. We will give notice before any change takes effect in a subsequent period
Purchased credits are usable under the terms in force at the time of purchase
Refund conditions are as stated on the packages page

11. Prohibited Conduct

Automated bulk data extraction (scraping) without our written permission
Attempting to breach the system, testing for vulnerabilities without authorisation, or causing abnormal load
Decompiling, decrypting or reverse-engineering any part of the system
Commercially redistributing our price data, indices or catalogue database without permission
Impersonating another person, our staff, or a member of the monastic community
Using the site for money laundering, fraud, or any unlawful purpose
Sending unsolicited or harassing messages through the chat system

12. Our Intellectual Property

The name, logo, user interface, software, catalogue data structure and index methodology are our intellectual property. Copying or commercial use without permission is prohibited. Ordinary use of the site by a normal user does not breach this section.

13. Service Availability

The service is provided as is and as available
Service may be interrupted for maintenance, improvement, or events beyond our control
We may change, add to or discontinue any feature. Where a change materially affects your rights we will give reasonable notice
We do not represent that the service will run without error or interruption

14. Limitation of Liability

To the fullest extent the law allows:

We are not liable for loss arising from transactions between users — non-delivery, items not as described, inauthentic items, non-payment, or any dispute between counterparties
We are not liable for decisions you make in reliance on reference prices, indices, articles, user opinions or folk belief content
We are not liable for indirect loss such as expected profit, business opportunity, or reputational harm
We are not liable for content created by other users
Where a court finds us liable, our aggregate liability is limited to the fees you actually paid us in the 12 months before the event, or THB 1,000, whichever is greater

This section does not apply to loss caused by our wilful misconduct or gross negligence, and does not exclude any consumer right that cannot lawfully be excluded.

15. Indemnity

If your breach of these terms or infringement of another party's rights causes us to face a claim, proceedings or expense, you agree to indemnify us for the resulting loss and reasonable costs actually incurred, including legal fees.

16. Disputes Between Users

We may provide supporting information — in-platform message records and transaction history — in response to a substantiated request or a lawful order, to help the parties or the authorities resolve matters. However, we are not an adjudicator or arbitrator, and have no obligation to compensate either side.

17. Changes to These Terms

Every version carries a version number and an effective date
Where a change materially affects your rights, we will notify you by email or on-site notice before the effective date
Continuing to use the service after the effective date constitutes acceptance of the new version. If you do not accept it, you may close your account
The system records which version you accepted, so this remains auditable

18. General

Assignment: you may not assign your rights or obligations under this agreement without our written consent
Severability: if any provision is void or unenforceable, the remainder stays in force
No waiver: not exercising a right on one occasion is not a waiver of that right
Relationship: this agreement creates no agency, partnership or employment between us
Governing language: this document exists in Thai, English and Chinese. Where the texts differ, the Thai version prevails
Incorporated documents: the Privacy Policy, the Cookie Policy, and the specific rules published on each service page form part of these terms

19. Governing Law and Jurisdiction

This agreement is governed by the laws of the Kingdom of Thailand. Disputes arising out of or relating to it fall within the jurisdiction of the Thai courts.

If you are a consumer under Thai consumer protection law, this section does not remove your right to bring proceedings in a court with jurisdiction under that law.
